1. General Interpretation

In these Terms of Service, the following words shall have the meaning assigned to them except where the context otherwise requires: -

"we", "our", "us" and "GYP" refers to Global Yellow Pages Limited.

"you" and "user" means a person accessing or using the Web Portal or the Services, including via other websites, domains or social media platforms, whether registered with the Web Portal as a member or otherwise browsing through the Web Portal as a visitor.

"Content" refers to all information including but not limited to data files, written text, music, audio files or other sounds, photographs, videos, images, signs, slogans, marks, graphics, layout, script, or hyperlinks, provided or made available on or through the Web Portal.

Web Portal" means this Tampines Web Portal at http://www.mytampines.sg, including all Content and Services available thereon.

"Services" refers to all content, materials, applications, services and functionality provided or made available on or through the Web Portal.

"Third Party Information" refers to data, information and/or opinions from various third party individuals and/or organizations that are not generally controlled, influenced, affiliated or otherwise connected with GYP.

2. Your relationship with MyTampines

2.1 Your access to and use of the Services and/or the Web Portal is subject to the following:
(1) These Terms of Service;
(2) The Web Portal’s privacy policy, found at http://www.mytampines.sg/privacy-policy which is incorporated here by reference;
(3) Any other legal notices published by GYP on the Web Portal; and
(4) The Terms of Services for third party content providers as listed on their respective websites.

If you do not agree to any provision of these Terms of Service, including documents incorporated by reference as mentioned above, please do not use or access the Web Portal or the Services.

2.2 By using, accessing and/or continuing to use or access the Web Portal and/or the Services and/or any part thereof, you hereby accept, without limitation or qualification, and agree to be legally bound by, the Terms of Service here and for content, products and/or services provided by third parties, the Terms of Services here and by the respective third parties. GYP reserves the right to amend these Terms of Service at any time and without notice to you, and it is your responsibility to review and take note of any changes to the Terms of Service each time you use or access the Web Portal and/or the Services. Your use of or access to the Web Portal and/or the Services following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. Nothing in the Terms of Service shall be deemed to confer any third party rights or benefits.

2.3 This Web Portal may contain content, products, services or links to other websites which are neither maintained nor controlled by GYP. Please refer to those respective websites in respect of their terms and conditions.

3. Your responsibility

3.1 The Web Portal and/or the Services may include data, information, forum boards, classifieds, chat rooms, and other user and/or member and/or third party created pages whether or not interactive. In respect of any or all of the aforesaid:

3.1.1 You shall not at any time use the Web Portal and/or the Services and/or any part(s) thereof for or to effect any unlawful, offensive, abusive, defamatory, obscene, racist, anti-social or otherwise objectionable purpose(s) and/or act(s) or to give rise to any inference that the same has, or may have, been caused or will be caused (as determined by GYP in our sole and absolute discretion).

3.1.2 Any use of the Web Portal and/or the Services and/or any part(s) thereof shall at all times be strictly in the utmost of good faith. In particular, you shall not post or transmit or cause to be posted or transmitted information, text, photographs, videos, messages, graphics, material or data of any kind (collectively, "material") which may contravene this Clause 3, including the intent and/or purpose(s) thereof (as determined by GYP in its sole and absolute discretion), including but not limited to (a) material that encourages or may encourage conduct that could constitute any criminal or otherwise unlawful, immoral or anti-social act; (b) material which may violate the rights of or cause distress to any third party (as determined by GYP in its sole and absolute discretion); (c) material which is abusive, threatening, obscene, defamatory or known by you to be false or misleading; and (d) material which involves unsolicited bulk emails or messages.

3.1.3 You shall use your best efforts to preserve and protect the integrity of the Content and you shall forthwith notify GYP of any infringement of any third party’s rights, whether actual, apparent, real or perceived, whenever occurring or determined, of such Content and render all reasonable assistance to GYP in the enforcement of its rights and particularly upon request.

3.1.4 Your use of the Web Portal and/or the Services and/or any part(s) thereof shall, unless specifically authorized in writing by GYP, whether or not subject to any terms and conditions (but which shall at all times be duly signed by GYP and you), and subject always to this Clause 3, be strictly limited to accessing the Web Portal and/or the Services and/or any part(s) thereof via the URL to view the information posted therein. You may use the Web Portal and/or the Services only in the manner intended by GYP and in any case in a reasonable manner. Where the Services so permit, you may input the requisite data in the fields designated for it and view such information as may be generated in response. The intellectual property rights to or over the Content contained in each Site belong to GYP and its Content Providers. The Content of the Site cannot be reproduced, modified, transferred, distributed, republished, downloaded, posted or transmitted in any form or by any means including but not limited to electronic, mechanical photocopying or recording without the prior written permission of GYP or the respective Content Providers. You agree that the material and Content contained within or provided by the Site is for your own personal use only and may not be used for commercial purposes or distributed commercially. Any other uses are prohibited unless prior written consent of GYP or its respective Content Provider has been obtained. The aforesaid shall be the extent to which your permission to use the Web Portal and/or the Services and/or any part(s) thereof shall endure. Any such information as you may be licensed to view under this Clause 3.1.4 shall not include any right to copy or make copies of the same. Any repeated viewing of any such information herein shall strictly be via a re-accessing of the Services and/or the Web Portal and/or relevant part(s) thereof. Any rights not expressly granted herein are reserved.

4. Disclaimer of Warranties and Liability

4.1 The Contents of this Web Portal provided are on an "as is" basis without warranties of any kind. This Web Portal may contain Content posted on or via the Site by Third Party Content Providers. GYP nor its Third Party Content Providers do not warrant and hereby disclaims any warranty:
• as to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the Contents of this Web Portal;
• that the Contents available through this Web Portal or any functions associated therewith will be uninterrupted or error-free as to the accuracy, correctness, reliability, timeliness, non-infringement, title, or that defects will be corrected or that this Web Portal and the server are and will be free of all viruses and/or other harmful elements.

GYP or its Third Party Content Providers shall also not be liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of the Web Portal, including but not limited to any damage or loss suffered as a result of reliance on the Contents contained in or available from the Web Portal.

This Web Portal contains hyperlinks to websites which are not maintained by GYP. GYP is not responsible for the contents of those websites and shall not be liable for any damages or loss arising from access to those Websites. Use of the hyperlinks and access to such websites are entirely at your own risk. Please refer respective parties’ websites for their terms and conditions.

5. Payment Transactions

5.1 GYP shall not be liable for any payment fraud or loss of information. You shall use your best efforts to preserve and protect your personal account information. 5.2 GYP shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the Goods nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of the Goods.

6. Governing Law

6.1 These Terms of Use shall be governed and construed in accordance with laws of the Republic of Singapore.

6.2 These Terms of Use are for the benefit of GYP and any third party Content Providers to the Site. Each of these entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
